Terms of Service

1. Acceptance of Terms

By creating an account or using Kongatrader ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Kongatrader is a Windows desktop application that replicates trade executions from a designated leader account to one or more follower accounts via broker APIs (Tradovate, ProjectX/TopstepX). The Service is execution infrastructure only — it does not provide investment advice, trade signals, or financial recommendations.

3. Subscription and Billing

  • The Service costs $30/month after a 7-day free trial (credit card required at signup).
  • Subscriptions renew automatically each month. You may cancel at any time from your account dashboard.
  • Payments are processed by Stripe. Refunds are not provided for partial billing periods.
  • Access is revoked after a grace period of up to 24 hours following a failed payment. Your data is retained and access is restored upon resubscription.

4. Acceptable Use

You agree not to:

  • Use the Service to violate any applicable law or broker terms of service.
  • Attempt to reverse-engineer, decompile, or tamper with the software.
  • Share, resell, or sublicense access to the Service.
  • Use the Service in a manner that could damage, disable, or impair our infrastructure.

5. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that trade replication will execute without slippage, delay, or failure. Trading involves significant financial risk. You are solely responsible for all trading decisions and outcomes.

6. Limitation of Liability

To the maximum extent permitted by law, Kongatrader and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to trading losses, missed executions, or data loss. Our total liability shall not exceed the amount you paid for the Service in the 30 days preceding the claim.

7. Termination

We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, at our sole discretion, are being used in a harmful manner. You may cancel your account at any time.

8. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

9. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration.
